New Akrama Scheme is likely to earn an additional Rs 1000 cr

The government plans to regularize all unauthorized layouts and housing sites developed before December 31, 2009 as against December 31, 2008. In the run-up to the BBMP polls, the government drastically slashed penalties from 20% to 8% for residential building and 25% to 20% for commercial buildings.

Continuing its efforts to fill its empty coffers and also with an eye on the upcoming BBMP polls, the state government on Wednesday indicated that the Akrama-Sakrama scheme will take a definite shape within a week.The cabinet sub-committee for regularisation of unauthorised constructions decided to issue a notification soon.

Initially, the revenue target was Rs 4,000 crore from this scheme.Now, with the extension of deadline it is likely to earn an additional Rs 1000 crore.The Akrama-Sakrama scheme was originally formulated during former chief minister H D Kumaraswamy’s regime but could not be implemented following strong opposition from people over high penalty rates.The then government had amended the Karnataka Town and Country Planning Act to introduce the regularisation as a one-time measure.

Property Cards will serve as authentic documents

Today it is world of cards where you will have credit card, debit card, petro and membership cards. Now property owners in Karnataka will soon have property card which will serve as authentic documents.

When the Karnataka Land Grabbers (Prohibition) Act comes into force soon, it’ll bring in transparency by cleaning up land records. Sources in the revenue department said that, with new rules in place, registration of sale deeds would be replaced with registration of titles. This will be done by introducing the progressive system of property titles and maintenance modeled on the Torrens System. The newly formed task force for eviction of encroachers on government land is also part of it.

The Karnataka Land Revenue Rules provide for a detailed inquiry of urban properties which can be done by the survey department following a procedure of issuing notices, hearing objections, ascertaining documents and finally writing property cards. The property card proposal is currently awaiting presidential assent.

There are about 15 lakh properties under BBMP and still more in the 2,000 sq km of Bangalore Urban district.In Bangalore,survey of property was last undertaken in 1975. It’s estimated that about 150 qualified surveyors would be required to complete the city survey inquiry.Even if a citizen pays Rs 500 to get the highly dependable property card, the cost of the project can be met. The present system of registration of documents can be misused quite often. With new rules in place, registration of sale deeds would be replaced with registration of titles.

The Akrama-Sakrama Scheme, formulated during the H.D. Kumaraswamy government in 2007, could not be implemented following strong protest and severe criticism against regularizing the structures that violated the building bye-laws and the high penalty rates. The Cabinet Subcommittee, which met on Tuesday, has recommended slashing of penalty rates. The Akrama-Sakrama is expected to be ready for implementation in about a month from now, as the BBMP has to also finalize the penalties.

The Akrama-Sakrama Scheme regularize the property by imposing penalty on property that are either constructed violating building bye-law or purchased land outside the erstwhile city corporation limits. The scheme involved the payment of one time penalty by property ranging between Rs. 5,000 (for minor violations) to Rs. 2.10 lakh.

Regularization of unauthorized apartment

In case of regularizing an apartment, only the apartment owners association is authorized to apply for regularization and not individual apartment owners. If the association does not apply for regularization, then the supply of water and electricity is liable to be disconnected after issue of notice. An apartment coming up in an area allocated for parking cannot be regularized at all. If the application for regularization is not considered, then the fees will be refunded.

What Akrama-Sakrama Scheme means

If the violations in residential buildings in BBMP limits are within 25 per cent, penalty will be 6 per cent of the guidance value of that particular locality. If violations are more than 25 per cent, then penalty is 8 per cent. For commercial property violations within 25 per cent in BBMP limits, fines will be 20 per cent while for violations more than 25 per cent, fines will be 35 per cent.

Authorities cannot go above the fixed rate while collecting penalties though they can reduce it. The meeting also said violations in residential buildings should not be more than 50 per cent, while putting a cap of 25 per cent for commercial buildings. The earlier rule had considered 15 per cent and 20 per cent of the guidance value for residential building violations (within and more than 25 per cent violations), while it was 25 per cent and 40 per cent of the guidance value for commercial property violations.

Conditions for Regularization

The penalty will be based on the location of the unauthorized structure in a given zone. However, building law violations should be not more than 50 per cent for residential structures and 25 per cent for commercial buildings. Unauthorized constructions on government properties, parks and footpaths will be ineligible for regularization under the scheme. Further, people could seek regularization over a six-month period as against the earlier three-month period.

The Cabinet Subcommittee has recommended slashing of penalty rates applicable under the earlier Akrama-Sakrama Scheme by nearly 50 per cent. The Legislative Assembly recently adopted the Karnataka Land Revenue (second amendment) Bill 2009 which seeks to regularize all unauthorized layouts and housing sites developed prior to December 31, 2008.

Recommended Penalty

The penalty that the owner of a building on an unauthorized residential site measuring 20 feet by 30 feet will vary between Rs. 30,000 and Rs. 45,000 compared to the Rs. 72,000 which was fixed earlier. For 30 feet by 40 feet unauthorized site, the penalty will range between Rs. 60,000 and Rs. 90,000 compared to the Rs. 1.62 lakh fixed earlier. For a site measuring 40 feet by 60 feet, the penalty will vary between Rs. 1.80 lakh and Rs. 2.10 lakh compared to the Rs. 4.23 lakh suggested earlier. The penalties, which were earlier roughly 15 per cent of the guideline values of the properties, have now been reduced to 8 per cent.

The estimation is that there are nearly seven lakh unauthorized structures in Bangalore alone. The Akrama-Sakrama is expected to be ready for implementation in about a month from now, as the BBMP has to also finalize the penalties based on the residential and commercial zones.

More than 300 volunteers and citizens took part in a clean-up campaign launched by two non-governmental organisations, Youth for Seva and Anonymous Indian Sunday at Malleswaram, Banashankari, G.M. Palya and Vijayanagar.At Malleswaram, the volunteers marched with drums and slogans to create awareness about cleanliness.

The volunteers asked the residents to bring out garbage and showed them how to separate wet waste from dry waste.Residents came out of their houses in response to the campaign and many of them joined the volunteers to clean up the neighborhood.The volunteers explained right way for segregation of waste and disposing it.

The clean-up campaign was to create awareness about cleanliness and message for people that they should not wait for Bruhat Bangalore Mahanagara Palike (BBMP) to do everything. people’s participation is necessary if they want to see the city clean.

According to a revenue official, the last date to pay the first installment of property tax for the financial year 2009-10 ended on Sunday. From beginning of financial year to  August 30, Bruhat Bangalore Mahanagara Palike (BBMP) has collected approximately Rs. 380 crore as property tax from around 4.3 lakh residents of the city.

Last year, around 7.5 lakh property owners paid tax to the tune of Rs. 748 crore to the civic authority. The official said property owners had just two months’ time to pay the property tax under self-assessment scheme last year. This year however, they have been given abundant time and they can pay the tax, albeit with penalty, till October-end.

The official said that the civic authority hoped to collect at least Rs. 800 crore as property tax this year. BBMP targets for 1000 crore and to ensure 100 per cent payment, BBMP will use Geographical Information System, that enables to scrutinize the details such as built-up area, number of floors and usage of the property.

While four lakh owners filed their tax returns at various centers identified by the BBMP, more than 30,000 property owners chose to go online. The official also said that the BBMP had received a lot of complaints from property owners last year about the cumbersome procedure involved in filing the tax returns.

BBMP is all set to issue notices to 50,000 tax-evaders

Tax evasion was causing huge losses to the BBMP as people were avoiding paying crores of rupees. In the past, many Bangaloreans reduced the size of the buildings or commercial establishments or even knocked off one floor in a multi-floor building to reduce the property tax amount. If you’ve cheated while paying your property tax, you’re not going to get away so easily this time.

This year, BBMP roped in neighbors to get information about evaders. Informants were assured their identity would not be disclosed. This yielded great dividends and BBMP received about 20,000 tip-offs through emails alone. About 10,000 alerts came through letters and telephone calls. GIS technology helped BBMP confirm the violations,”

BBMP used GIS to record details of assets which come under the tax net. Detailed maps are drawn showing the area of the plot, taxable areas and the tax details. The moment the owner pays the tax his payable details, paid details are tallied and details of tax evaded are calculated. The GIS mapping also shows details of nonpayment of tax and the list of payments. Even small evasions are shown by GIS.

Common complaints of tax evasion

  • Residential sites used for commercial purpose
  • Wrong zone where tax is less
  • Building given for rent declared as own-use
  • Reduced built-up area

All tax evaders will receive notices shortly. BBMP has fixed targets for BBMP officials to issue these notices. After issuing the notice, owners will be asked to reply and the final list of all tax evaders will be posted on the BBMP website. Tax evaders have to pay double the fixed tax with an interest of 2%.

All Unauthorized Layouts and House Sites to Be Regularized

The Karnataka land revenue bill 2009 seeks to regularize unauthorized layouts and house sites developed prior to December 31, 2008. The details of the regularization process will be drafted in the rules to be formed under the amendments to the Land Revenue Act. There are large number of people who had constructed houses in unauthorized layouts or on unauthorized sites and were not in possession of valid ownership documents.

The Karnataka land revenue bill 2009 seeks to regularize unauthorized layouts and house sites developed prior to December 31, 2008.
It is a one-time measure to provide relief to a large number of people who had constructed houses in unauthorized layouts or sites. Nearly five lakh persons have purchased such sites and built houses thereon and are facing undue hardships. This is a one-time comprehensive scheme subject to certain reasonable conditions.

The legislation seeks to regularize all unauthorized structures and even the layouts and house sites formed on revenue lands, which include agricultural lands. In a way, the regularization announced under the Revenue Act is another format of the Akrama-Sakrama scheme contemplated nearly two years ago and has been awaiting implementation. However, that scheme is only pertained to jurisdiction of BBMP while amendment of bill is applicable to all over the state.

Under the new legislation, unauthorized structures or sites in natural drains, on government lands, the applicant has no title, beneath high tension lines etc., will not be regularized.
The H.D. Kumaraswamy-led coalition Government had taken pains to implement the Akrama-Sakrama scheme in 2007 and it was then estimated that nearly six lakh unauthorized constructions in Bangalore would stand to benefit. Under the new legislation, some of the conditions include — unauthorized structures or sites in natural drains, on government lands, coming in the way of existing or proposed rings roads, national highways etc, belonging to another person over which the applicant has no title, beneath high tension lines etc., will not be regularized. Property owner with more than two floors have to produce a certificate from a structural engineer and a no-objection certificate from the Fire and Emergency Services Department.

Register property with alternative documents

After two-and-a-half years of rigmarole over khata transfer and endorsement which had put property registrations in the erstwhile urban local bodies in a limbo, the Karnataka government has facilitated the sale-purchase transactions by suggesting alternative documents.

The government issued a fresh notification on August 12, 2009 about the acceptable documents during registration.On Aug 14, the inspector general of registration and commissioner of stamps K R Niranjan has written to the sub-registrars to follow the new guidelines and open up the registrations.

Since 2007 after the urban local bodies came under BBMP fold, property Owners who wanted to sell their properties could not do so. Now the government issued a fresh notification on the acceptable documents.The registration process for apartments located in these areas has also been made smooth now.

The khatas issued by the erstwhile CMCs, TMC or panchayats to which your buildings/sites belonged before becoming a part of the BBMP, will suffice to do property transactions.

You can submit following documents during property transaction

For buildings/sites in old urban local bodies:

  • copies of khata and assessment extracts issued by CMCs, TMC or village panchayats to whose jurisdiction the properties belonged
  • copies of property tax application and tax paid receipt under BBMP’s Self-Assessment Scheme
  • Sale of apartments: copy of registered sale deed of first transaction

Recession has opened opportunity for people seeking home or apartment at affordable price. Though real estate business hit by recession, it manage to get demand from property buyers and investors in short period. There are chances of sellers producing fake certificates, hence, check the authenticity of property before you buy them.

The hassle in purchasing unauthorized properties is that there are always chances of the property being demolished or heavy penalties being levied to regularize it. Check the details and authenticity of the property with civic agencies before buying the property. Layouts are indeed springing up on plots measuring up to three acres in places like Kengeri, Whitefield, Ulsoor and Sarjapura Road.

People should ask for no-objection certificates (NOCs) issued by civic agencies like the Bangalore Development Authority (BDA) and Bruhat Bangalore Mahanagara Palike (BBMP) before purchasing a property. Buyers can check lists of unauthorized properties on BDA, BMRDA and BIAPPA websites. The BDA website (www.bdabangalore.org) had listed 127 illegal layouts as in 2007 with their geographic location and details of builders.

Environment Cell to handle solid waste management

BBMP has formed an Environment cell which would exclusively handle solid waste management. Earlier solid waste management was handled to civic authority’s health department.

In November 2008, solid waste management was entrusted to the ward engineers. The civic authority decided to form a cell which would exclusively handle solid waste management on the lines of the one in the Bombay Municipal Corporation (BMC). The cell in BMC was managed by environment engineers.

BBMP has formed Environment cell and posted its eight environment engineers in the newly formed cell. More environment engineers will be recruited to newly formed cell. Mean while, ward engineer and medical officers of BBMP might opt to work in the cell. The civic authority has also written KPSC (Karnataka Public Service Commission) with regard to recruiting more environment engineers for the newly formed cell.
